Acceptance of these Terms
These Terms of Use (“Terms”) govern your use of dignitylivingsolutions.com (the “Website”), operated by Dignity Living Solutions LLC (“Dignity,” “we,” “us,” or “our”). By using the Website or submitting a form, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, do not use the Website.
You must be at least 18 years old to use the Website or submit information through it.
Scope
The Website describes Dignity’s management support, housing referrals, Provider Partner opportunities, and resident resource coordination. These Terms apply only to your use of the Website. A signed written agreement with Dignity, such as a Referral Partner Agreement, governs that relationship, and it controls if it conflicts with these Terms.
No medical, legal, or financial advice; not for emergencies
Information on the Website is general information only. It is not medical, legal, financial, or care-planning advice, and it is not a substitute for advice from a qualified professional. Dignity does not provide medical care, nursing services, or care assessments.
The Website is not monitored for emergencies. If you or someone else is in danger or having a medical emergency, call 911. To report suspected abuse, neglect, or exploitation of an older adult in Texas, call Adult Protective Services at 1-800-252-5400.
Housing referrals
Dignity may help review housing preferences and coordinate introductions to independent residential providers. A listing or suggested fit is not an admission offer. Each provider decides availability, admission, pricing, resident agreements, and services. Dignity does not guarantee placement or any outcome.
Our referral service is free to you. Participating providers pay Dignity a referral fee when they accept a referral and a placement fee if you move in.
We suggest communities based on your stated needs and preferences, and cost is never the only factor. The fees a provider pays do not affect which providers we suggest.
You may stop using our referral service at any time, without cause or penalty.
The providers we suggest may not include all providers in your area that meet your stated preferences and needs.
We do not refer you to any provider in which Dignity has an ownership, management, or financial interest, and we do not hold a power of attorney for, or any property of, anyone who uses our referral service.
We rely on the information you and providers give us, and we do not independently verify it. Before choosing a provider, you should visit it, review its resident agreement, confirm its rates, services, and licensing, and decide for yourself whether it meets your needs. Dignity is not a party to any agreement between you and a provider and is not responsible for any provider’s housing, care, services, or conduct.
Provider and vendor information
Providers and vendors are responsible for the accuracy of the information they submit. An application or public inquiry does not create approval, a contract, or a guaranteed opportunity. Contract terms apply only after an authorized agreement is signed by Dignity and the provider or vendor.
A public resource listing on the Website is provided for information only. It is not an endorsement, a recommendation, or a statement that the listed business is an approved or paid vendor.
Management services
Dignity is not currently accepting new outside management communities. A waitlist submission is only an expression of interest and does not create any obligation for you or for Dignity.
Information you submit
You agree to submit only accurate and current information that you are authorized to share.
If you submit information about another person, you confirm that you have that person’s permission, or the legal authority, to share it and to request help on that person’s behalf.
Do not submit medical records, Social Security numbers, Medicare or Medicaid numbers, bank or card numbers, or financial statements through Website forms.
By submitting a form, you agree that Dignity may contact you by phone, email, or text message about your request. We send text messages only as described in our Privacy Policy. Message and data rates may apply. Reply STOP to stop text messages or HELP for help.
Our Privacy Policy explains how we collect, use, share, and protect the information you submit.
Acceptable use
You agree not to:
use the Website for any unlawful, fraudulent, or harmful purpose;
submit false information, impersonate any person, or misrepresent your authority to act for someone else;
submit information about another person without permission or legal authority;
collect or harvest information about other users or providers;
use bots, scrapers, or other automated means to access the Website;
upload viruses or other harmful code, or attempt to gain unauthorized access to the Website or our systems;
interfere with the operation or security of the Website; or
copy, reproduce, or resell any part of the Website except as allowed by these Terms.
Intellectual property
The Website and its content, including text, graphics, logos, and the Dignity Living Solutions name and logo, are owned by Dignity or its licensors and are protected by law. You may view and print Website pages for your personal, non-commercial use. No other use is permitted without our written permission.
Links to other websites
The Website may link to websites of providers, vendors, resources, and other third parties. We do not control those websites and are not responsible for their content, practices, or availability. Visiting them is at your own risk and subject to their terms and privacy policies.
Disclaimers
To the fullest extent permitted by law, the Website and all information on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that information about any provider, including availability, pricing, or services, is complete or current.
Limitation of liability
To the fullest extent permitted by law, Dignity and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of your use of the Website or any provider’s housing, care, or services. Dignity’s total liability arising out of your use of the Website will not exceed one hundred dollars ($100). Nothing in these Terms limits any liability that cannot be limited under applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless Dignity and its owners, employees, and agents from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, your misuse of the Website, or information you submit without authority.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any claim, you agree to contact us and try in good faith to resolve the dispute informally for at least 30 days. If the dispute is not resolved, it must be brought in the state or federal courts with jurisdiction over Ellis County, Texas, and you and Dignity consent to the jurisdiction of those courts. Either party may bring a qualifying claim in justice court (small claims) instead.
Changes to the Website and these Terms
We may change, suspend, or discontinue any part of the Website at any time. We may revise these Terms by posting the updated version on this page and changing the “Last updated” date. Changes apply from the date they are posted. Your continued use of the Website after that date means you accept the revised Terms.
Termination of access
We may suspend or end your access to the Website at any time if we believe you have violated these Terms or misused the Website.
Accessibility
We want the Website to be usable by everyone, including older adults and people with disabilities. If you have trouble using any part of the Website, contact us and we will help you get the information or submit your request another way.
General
These Terms and our Privacy Policy are the entire agreement between you and Dignity about your use of the Website. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign your rights under these Terms. You agree that we may provide notices and communications to you electronically.
